Co continues to experience softness in demand from semiconductor capital and equipment industry and they continue to make progress in the strategic diversification of their business. The co mentions their solar invertor product line. For Q4 the co expects the weakness in the semi markets to continue. Short term, they do not anticipate the share gains will offset the effects of the industry fluctuations. Co expected seasonal softness in data storage and normal fluctuation in the glass markets. Co says they were encouraged to see L.C.D panel manufacturers return to profitability sooner than anticipated. The co believes the growing penetration of low E glass in commercial and residential construction, the increased complexity on the glass will drive sales to the first half of 2008 and throughout 2009. Co says with respect to extraordinary inventory levels that would create a protracted distance between them and the performance of the regular market, it’s the supply chain that is run pretty tight right now. So the co says they don’t think they see anything in the inventory range that would prevent them from performing with the overall market.

Historically, the Company has valued store inventory on the retail inventory method at each year end. Inventory balances calculated under R.I.M. approximate inventory balances that would have been obtained if every item of inventory had been valued at the Company’s purchase price through the use of a specific costing method. The Company has used R.I.M. to determine year-end inventory balances because the Company’s systems did not allow for scanning of each stock-keeping unit during year-end counting of physical inventories at the Company’s stores. For the first three quarters of each year, the Company used a S.C.M. for purposes of determining cost of sales. Through its point of sale systems, the Company is able to assign a SKU-specific cost to every item sold. Using this data along with estimated inventory shrinkage factors, the Company estimates interim cost of sales and inventory. Because a S.C.M. was used during these periods, management believes it is unlikely that results of operations for the first three quarters of 2007 and 2006 will be materially affected by this matter. Inventory held in the Company’s distribution center has historically been and is currently valued for all periods during the year using a S.C.M… Based on preliminary data, management estimates that total inventory for all periods between December 31, 2004 and June 30, 2007 may be overstated in the range of $15.0 million to $25.0 million.

Noting that results put them on track to deliver on their full year gross margin guidance from July. See gross and operating margins to trend similarly in 2008 to what happened in 2007. Saying the next big jump is to high-definition online video. Trying to ease margin concerns by saying that they see overall volume increasing and that they are still commanding a premium for the solutions they offer. Saying they “are not even in spring training on online HD, its about to get going”. Saying growth is still primarily organic. When asked about competition: Saying that their 1000 networks give them a differentiated performance and scale that their customers recognize. Noting that most of the largest data transport networks don’t connect to any end users. Noting that they will go into more detail at their analyst day next week. Noting that growth rate is slowing from what they saw in ‘06. But reiterating that they see 25-30% growth in ‘08. Saying that PCI compliance, and how the online world adapts, will be a “gigantic question” for commerical sites and that business that bring PCI solutions to market will have an advantage. Saying peer-peer is not a long term solution… an add-on not a replacement. Noting that they are fairly picky about their customer adds as they want all of their customers to be successful so that they can be long-term profitable customers. From 8-K: “On October 18, 2007, Pfizer (PFE) delivered a notice of termination of the Collaborative Development and License Agreement by and between Nektar Therapeutics and Pfizer, dated January 18, 1995, and certain other ancillary agreements related thereto. Under the terms of the Pfizer Agreements, this termination is effective ninety (90) days from October 18, 2007. This termination by Pfizer was in connection with its public announcement on October 18, 2007, that Pfizer decided to exit Exubera, the inhaled insulin product that is the subject of the Pfizer Agreements. Nektar is evaluating its contractual rights and other options with respect to Pfizer’s termination of the Pfizer Agreements, including Pfizer’s performance under such agreements. Nektar is also evaluating its options with respect to the inhaled insulin franchise, including the potential for finding another partner for the commercialization of Exubera and/or the development of the second generation inhaled insulin program… We expect to incur significant charges and other wind-down expenses in connection with the termination of the Pfizer Agreements and estimates of such potential charges and expenses are not available at this time… The termination of the Pfizer Agreements also subjects Nektar to additional risks and costs, including: Nektar’s revenue and results of operations have historically depended on sales to Pfizer. 17:30 BAC Bank of America: Follow-up on 17:21 WSJ layoff headline (47.48 -0.30) -Update-

WSJ reports the co is poised to launch a major shakeup of its investment bank, including layoffs and the retirement of the head of its Global Corporate and Investment Banking unit, people familiar with the plan told The WSJ. A Bank of America executive confirmed the plan and said an official announcement was expected. Gene Taylor, president of the unit and a 38-veteran Bank of America executive, will retire, according to people familiar with the plan. The bank will also lay off about 3,000 employees, with the biggest hits coming in the investment banking unit, and begin a comprehensive strategic review of that line of business, those people said. Succeeding Taylor as head of the unit will be Brian Moynihan. Moynihan, in turn, will be replaced by Keith Banks, who runs the Columbia Management mutual funds arm, those people said. Moynihan told The WSJ the shakeup isn’t a wholesale retreat from investment banking but an effort to acknowledge weaknesses and begin rebuilding for the future. Moynihan said the bank will continues to be active in treasury mgmt, commercial lending, debt issuance and other key services for big commercial customers.

With the current production facilities and these two tankers, the Company expects to produce ~2,500 barrels of oil per day (bopd) beginning in early November barring any unforeseen circumstances.

Reports Q3 (Sep) earnings of $0.27 per share, excluding non-recurring items, in-line with the Reuters Estimates consensus of $0.27; revenues fell 3.7% year/year to $104.8 mln vs the $113 mln consensus. Earnings for the third quarter 2007 fell by approximately $10 mln, net of the translation loss, period over period. This was largely due to the impact of a stronger Canadian dollar on operating costs and lower realized byproduct zinc prices, offset partly by a higher gold price. Earnings per share were also diluted by the issuance of approximately 13.8 mln common shares upon the acquisition of Cumberland Resources Ltd. in 2007. Payable gold production in Q3 was 55,830 ounces at total cash costs per ounce of minus $307. This compares with payable gold production of 59,603 ounces, at total cash costs per ounce of minus $709, in 3Q06. On December 10, 2007, the 2008 production and cost forecast is expected to be announced. At this time, the co expects to provide an update on the six development projects including updated capital expenditure estimates incorporating more recent exchange rates. The Board of Directors is expected to make a decision regarding the 2007 dividend at that time. Exploration updates are also expected for several of the development projects prior to the February reserve and resource update.

The co announces “that it has resumed normal production at its Pinnacle Mine in Pineville, W. Va., after completing the move of its longwall plow system. Production at Pinnacle slowed in August as a result of sandstone intrusions encountered within the coal panel being mined at the time. This slowdown prompted the decision last month to move the mine’s longwall plow system to another panel. As a result of completing the longwall move, Cliffs updated its total metallurgical coal production forecast for all three of its U.S. metallurgical coal mines–Pinnacle, Green Ridge and Oak Grove–to 1.1 mln tons for the last five months of 2007, compared with a previous forecast of 2 mln tons.”

Some disappointing earnings developments, a weak existing home sales report, and a spike in oil prices precipitated a sharp decline in the major indices in the early-going. A late-day rally, however, made things look a lot better by the closing bell than they had been… Once again, there was a host of companies reporting quarterly results. The two reports that drew the most attention, and which were most responsible for the early declines, were the ones from Amazon.com (AMZN 88.73, -12.09) and Merrill Lynch (MER 63.22, -3.90)… In the case of Amazon, it actually beat the consensus EPS estimate by a penny and issued in-line guidance. With shares of AMZN up 49% from their July low, though, momentum accounts wanted more and sold the stock aggressively when they didn’t get it. In turn, underlying concerns about Amazon’s profit margins also drove the selling interest… The strikingly negative response to Amazon’s report got the better of a lot of high-flying technology stocks, as investors moved to secure profits. Those losses weighed heavily on the broader market and culminated in a 79-point drop for the Nasdaq Composite at its lows for the session… The Dow and S&P suffered considerably, too, with declines of 205 points and 30 points, respectively, at their worst levels. A dreadful third quarter report from Merrill Lynch, which posted a net loss of $2.85 per share from continuing operations after recording a massive $7.9 billion write-down for collateralized debt obligations and U.S. subprime mortgages, served as a driving catalyst… Merrill Lynch’s stock held up reasonably well initially, but when the news hit that Standard & Poor’s cut its debt ratings for the investment bank, and noted a negative outlook, losses in the stock accelerated… The financial sector (-0.8%) was taken along for the ride on pressing concerns that Merrill’s bad news suggests more write-downs will be coming in the fourth quarter. In brief, the realization hit that the third quarter may not have been the bottom for the financial sector as many pundits had claimed… Compounding the selling activity was the indication from the National Association of Realtors that existing home sales fell 8.0% in September to an annualized rate of 5.04 million units (consensus 5.25 mln) while median prices dropped 4.2%… Soon after the existing home sales report, the Dept. of Energy’s inventory report showed sharp declines in stockpiles versus the market’s expectations for a build in inventory levels. The surprising drawdown led to a 2.2% increase in crude prices to $87.10 per barrel… After suffering the early pounding, the stock market attempted to recover the lost ground in halfhearted fashion. The initial recovery try failed and the indices eventually rolled over again. However, when the indices retested their early morning lows around 2:00 pm ET and held, buyers stampeded back into the market and drove the Dow back to positive territory an hour later… The successful rebound effort most likely prompted some short-covering activity that contributed to the expeditious recovery… Separately, there was some speculation that the Fed might be on the verge of cutting the discount rate, but a Fed spokesman declined to comment on that speculation. Even so, the prospect of further rate cuts and the successful retest of the morning lows were motivating factors that spurred the renewed buying interest… The Treasury market for its part benefited from the stock market’s volatility and the weak housing data. The 10-year note gained a half point and saw its yield drop to 4.34%.

Market trying off the open to rally once again, but lower lows the mantra and I continue to believe you have to sell the rips and buy the dips until the FED next week. So we are going nowhere but trading happens and money can be made in this market. So keep on selling those lower rips and buy the higher dips.
