WSJ reports as three of the world’s biggest banks try to finalize a rescue plan for some shaky investment funds, the funds themselves face mounting problems. The outlines of a new superfund — an effort led by C, BAC and JPM that may include at least seven other banks — are still being hashed out, according to a person familiar with the situation. The three banks could present a formal structure to potential bank partners and funds as soon as next week. Meanwhile, the funds at the heart of the situation — known as structured investment vehicles, or SIVs — need to find investors for $100 bln in debt coming due in the next six to nine months, even as ratings cos continue to come out with reports that lower the ratings of securities in moves that could further depress the value of SIV holdings.

Today, investors in Palo Alto, California-based VMware will get to make another comparison with Google, and may decide whether the run-up in the shares is justified. It also operates in Singapore, though that unit will move to India in December. Atwood rents out its rigs by contract to the highest bidder. Long-term contracts help shield the co from volatility in the mkt. For instance, when a violent storm like Hurricane Katrina shuts down a rig, Atwood still gets paid. CFO James Holland said Atwood has co contracts in place for 98% of this year’s drilling days, 80% of next year’s and 30% of 2008’s. The NY Post reports the Dolan family’s pursuit of Cablevision (CVC) remained up in the air last night as some big shareholders, which previously were against the $22 bln takeover indicated they may vote in favor of the deal. According to a source who spoke on the condition of anonymity, Harris Associates and Anchor Capital Advisors, which together hold over 3% of shares, will vote for the $36.26 per share offer from the Dolans. So, too, will Alchem Investment Partners, which owns less than 1% of Cablevision, sources said. T. Rowe Price, Cablevision’s third-largest shareholder with a 5.7% stake, is wavering from its previously stated plan to vote against the deal and may indeed cast its shares in favor of it during today’s vote, several sources said. A spokesman for the mutual fund said the firm had no comment about the vote. Rumors also swirled about a last-minute switch from Marathon Asset Management, which owns 5.3% of the co and previously indicated it was against the deal. ClearBridge Advisors, Cablevision biggest shareholder on record with 31 mln shares, remains steadfastly opposed to the Dolans’ offer, sources said. The Dolans, who have indicated they will not modify their original offer, need a majority of the 113 mln nonfamily shares, in order for it to go through.

The Wall Street Journal reports the FDA wants GlaxoSmithKline (GSK) to add the strongest form of safety warning about heart-attack risk to the label of its diabetes drug Avandia, according to people with knowledge of the matter, a move that would compound the commercial woes of the once-popular medication. Agency officials are pushing for a “black box” warning, these people say. The new label is still being discussed with the co and its final form isn’t yet clear. In high-profile safety matters, the agency tends to have strong leverage. The new warning would be a blow to GlaxoSmithKline, which had said there isn’t clear evidence Avandia is more dangerous than competitors. Avandia already carries a black-box warning about a different side effect — heart failure — but a heart-attack warning would be more serious. Avandia’s main rival drug, Takeda Pharmaceutical’s Actos, carries a heart-failure caution, but doesn’t have one for heart-attack risk. An FDA spokeswoman said the agency “is still involved in internal discussions on this matter” and that when there is a final decision it will become public. A GlaxoSmithKline spokeswoman said the co is “working diligently with the FDA to finalize the label, but it would be inappropriate for us to discuss the ongoing conversations with the agency.”

The exact percentage and value of the stake are unclear, but it will be greater than $30 mln, according to another person involved in the deal. ChemPartner has been approached by other suitors interested in investing around $30 mln to $50 mln for about 20% to 25% of the co, a person familiar with the matter said. TPG initially expressed interest in investing in WuXi PharmaTech (WX), the largest pharmaceutical contract-research co in China by number of researchers, and ChemPartner’s main rival for business, according to a third person familiar with the matter. TPG didn’t say why it passed up a deal with Wuxi, according to this person.
