It is co’s understanding that SLM has terminated its tiered discount program for all schools. As a result of the changes that SLM had made to its lending practices that led to the tiered program and in anticipation of changes in student financing, co has already taken steps to minimize the use of SLM funds to finance our students’ education. Co believes that SLM’s decision to terminate its tiered discount loan program will have a minimal impact.

POT is expected to report 4Q07 earnings tomorrow before the market open. Current Q4 consensus calls for EPS of $0.98 and revs of $1.24 bln. The co usually provides financial guidance in the press release. Guidance: On Oct 25, co reaffirmed guidance for FY07, sees EPS of $3.00-3.25 vs. $3.24 consensus… Segment revenues: Potash (33%), nitrogen (34%) and phosphate (33%). Past Performance: POT has beaten earnings in the last three quarters by $0.04-0.13 per share. Last quarter, the co beat by $0.04 and beat on revs… POT will be the first of the fertilizer group to report earnings, and there are current debates about how much planting will be shifted from corn acres to soybeans and wheat this coming crop season. And this is very important to POT because corn requires more fertilizer use per acre over the other major crops. The fertilizer group has declined with the market recently, but isn’t exactly running on the same cycle as the market, especially considering the huge run-up in agriculture commodity prices. This is why it’s difficult to precisely explain to large declines to group has been seeing. Although, ag prices are down today, these higher commodity prices naturally gives farmers additional incentive to optimize the use of fertilizer and try to maximize yields and protect soil fertility, hence higher fertilizer sales. Areas of focus on the Call: Topics include volume growth, pricing power, ability to pass along higher input costs, and what the co thinks crop rotation may look like this crop year (e.g. how much in corn acres planted may be shifted to wheat and soybeans). What’s key in the cos report tomorrow is where volumes and inventories are at and what’s the co’s outlook is in these areas, as well as where ocean freight rates are. Last quarter, ocean freight rates have been knocking down some of the favorable pricing power POT is receiving. Last quarter: North American realized prices contributed to this result, improving by 20% ($33 per tonne) quarter over quarter. Total volumes (2.2 mln tonnes in Q3); Total volumes of 2.2 mln tonnes were up 3% from last year’s third quarter and year-to-date volumes were 42% ahead of 2006 totals. Ending inventories yr/yr (41% lower in Q3)… POT should guide for Q1 and 2008 tomorrow morning. It’s more likely that the co will guide above consensus, mainly due to continued higher commodity prices, and the ability to pass along higher input costs. Co provided an update on activities conducted following release of the preliminary Phase II data and outlined the resulting clinical development plan for intramuscular peramivir. Following release of preliminary Phase II results in September 2007, the co completed additional analyses of the clinical data and performed a preliminary analysis of the virologic data from this trial. Preliminary analysis of the virologic data from the Phase II trial indicated that i.m. peramivir demonstrated statistically significant reductions in influenza virus shedding in both active treatment groups when compared to placebo, with greater reductions in the 300mg group. Additionally, pharmacokinetic studies have been completed that indicate that needle length impacts adequate and consistent systemic exposure to i.m. peramivir.

As a result of James Kindley’s resignation from the Board of Directors on December 17, 2007, the Company’s audit committee presently has only two members. NASDAQ has requested the Company provide, on or before June 16, 2008, documentation evidencing compliance with Marketplace Rule 4350.
