DJ reports CME Group’s (CME) $11 bln bid for the co was endorsed by one of Nymex’s biggest shareholders, despite CME’s valuing Nymex at a lower price than investors had all last year. While some analysts have questioned whether Nymex shareholders will accept the combined cash-and-stock bid, which is 12% below Nymex’s price at the end of last year, many Nymex members are keen to participate in the merger mania that has gripped exchanges in recent years. “The CME and Nymex combination would be a great deal, it would create huge savings that would drop right down to the bottom line,” said Eric Bolling, a major Nymex shareholder and one of the most active traders on the exchange. “As a shareholder, I’d like to see a higher price, but not at the expense of losing the deal.” Bolling said a merger with another exchange, such as NYSE Euronext (NYX), would also deliver the same type of savings.

DJ reports Solar and wind-power companies won support for a one-year extension of key tax credits, as a Senate panel included the tax breaks in an economic stimulus package. The Senate Finance Committee agreed to an economic stimulus bill Wednesday that would extend tax credits for new wind and solar projects through the end of 2009. The ultimate fate of the measure remains uncertain as President George W. Bush is trying to pressure the Senate to agree to a more limited bill passed by the House. Under the Senate Finance Committee’s measure, wind-generation companies would receive a tax credit, currently 2 cents per kilowatt hour of electricity generated, for each new wind turbine that goes into operation through 2009. The tax credit, which also would apply to electricity from geothermal and other sources, would cost $3 bln over 10 years, according to a document summarizing the details.

AS mentioned at 16:55, NY Times reports the LLY and federal prosecutors are discussing a settlement of a civil and criminal investigation into the company’s marketing of the antipsychotic drug Zyprexa that could result in Lilly’s paying more than $1 bln to federal and state governments. If a deal is reached, the fine would be the largest ever paid by a drug company for breaking the federal laws that govern how drug makers can promote their medicines. Several people involved in the investigation confirmed the settlement discussions. They insisted on anonymity because they have not been authorized to talk about the negotiations.

Co says it is seeking marketing approval for ferumoxytol as an intravenous treatment of iron deficiency anemia in patients with CKD in December 2007. The NDA is supported by data from three open-label, multi-center, randomized Phase III efficacy and safety clinical studies and a fourth Phase III safety study. The three efficacy and safety studies demonstrated a statistically significant achievement of all primary and secondary endpoints. In total, over 1,700 patients and healthy volunteers were treated with ferumoxytol in the co’s eleven clinical studies… As for morbidity and mortality rates, in the ferumoxytol clinical development program, none of these deaths were considered to be related to study treatment. The incidence of deaths following ferumoxytol treatment was lower than following oral iron treatment, and was 1.1% among ferumoxytol subjects compared to 2.8% among oral iron subjects. For deaths that occurred within 30 days of the last study treatment, the incidence was also lower with ferumoxytol, and was 0.7% among ferumoxytol subjects compared to 1.4% among oral iron subjects… As for adverse events, in the co’s three open-label, multi-center, randomized Phase III efficacy and safety clinical studies, the overall incidences of adverse events and serious adverse events occurring after study treatment were both lower following ferumoxytol treatment (2 x 510 mg) than following oral iron treatment. The AE rate was 44.0% among ferumoxytol subjects compared to 53.9% among oral iron subjects, and the SAE rate was 9.8% among ferumoxytol subjects compared to 12.1% among oral iron subjects.

DJ reports the co and TTM are nearing an agreement for Tata to buy Jaguar and Land Rover, according to a person who has been briefed on the negotiations. The deal is likely to be announced in February, perhaps as early as next week, but could be as late as the Geneva Motor Show in early March, the person said. Ford CFO Don Leclair said last week the co doesn’t plan to keep a stake in the storied British auto makers. “Our plan right now is to sell the business in its entirety,” Leclair said in a telephone interview with British newspaper the Financial Times. Ford spokesman Bill Collins confirmed the quote as accurate. The person briefed on the talks, who requested anonymity because the negotiations are private, said Tata and Ford are negotiating an agreement for Ford to keep supplying engines and other technology to Jaguar and Land Rover.

Equity markets did exactly the opposite of what many trader’s & participants anticipated, rallying sharply to session highs & holding those gains going into the last hour of trade. However, negative news began circulating @ approx. 3:15p.m. Est coming out of the bond insurers (ABK, MBI) & coupled with a Fitch downgrade of FGIC, sellers pressured stocks & futures indices & subsequently took them down from their highs to the lows. In the end, we had mixed results as the Nasdaq 100 & Dow Tran. index finished with gains. Unofficially, INDU settled @ 12442 -37.50, SPX @ 1356 -6.50, COMPQ -2349 -9.00, NDX @1808.5 +0.80, & RUT @ 695.50 -9.70. Today’s sector strength is noted in Transports (IYT +1.6%), Semiconductors (SMH +0.90%), Gold (GLD +0.75%), & Industrials (XLI +0.40%) while weakness was seen in Homebuilders (XHB -5.3%), Energy (OIH -2.9%), Real Estate (IYR -2.7%), & Agribusiness (MOO -2.3%).
